1. Purpose
This section regulates the specific conditions applicable to the reservation of vacation apartments made through the website poloapartments.com. By completing a reservation, the user expressly accepts the terms described herein, in addition to the general policies of the site.
2. Booking and payment process
- The reservation is considered confirmed only after the payment of 15% of the total amount, processed via the Stripe payment gateway.
- The remaining 85% will be automatically charged seven (7) days before the scheduled check-in date.
- If the reservation is made less than seven days before check-in, 100% of the total amount will be charged at the time of booking.
- The user expressly authorizes the scheduled charges in accordance with these conditions.
- All payments are securely processed through Stripe, a certified provider under PCI-DSS standards.
3. Modifications and cancellations
- Guests may request a cancellation of their reservation until seven (7) days’ notice before the scheduled check-in.
- Requests must be made in writing, either via the form provided on the website or by WhatsApp message.
- If the request is made within the deadline, the deposit will be refunded, with deduction of any applicable bank or transaction fees.
- After this deadline, no cancellations or modifications will be accepted, and the scheduled 85% charge will be processed as planned.
4. Security deposit preauthorization
- As a guarantee of proper use of the accommodation and compliance with the rules, the guest authorizes Polo Apartments to charge a deposit up to €150 using the card details provided at the time of booking.
- The charge may be made up to 12 hours after the time of departure from the reservation.
- This amount will not be charged unless damage or breaches of the house rules are detected, in which case it may be charged in full or in part, after notifying the customer.
- Justification must be provided electronically within 7 days of the end of the reservation.
5. General rules
The guest agrees to abide by the following rules during their stay in the apartments managed by Polo Apartments. These rules are intended to ensure comfort, safety, and peaceful coexistence among all guests and neighbors.
- Prohibition of animals: Pets are not allowed in the accommodation, including dogs, cats, birds, rodents, or other domestic animals. Any breach of this rule may result in the immediate cancellation of the stay and the application of additional cleaning or repair charges.
- Minors restriction: In the Polo 7A, Jacaranda 5E, Jacaranda 4E and Jacaranda 8B apartments, the stay of minors is not permitted.
- No smoking: It is strictly forbidden to smoke or vape inside the apartment.
Smoking is only permitted on terraces or private outdoor areas, provided it does not disturb other neighbors and ashtrays are used to avoid damage or fire hazards. - Parties and noise: Parties, events, or gatherings that disturb the neighbors’ rest are not allowed. Guests must maintain a moderate noise level at all times and respect the quiet hours between 11:00 p.m. and 8:00 a.m.
- Maximum occupancy and visitors: The number of guests staying must not exceed the number indicated in the reservation. Visits of up to 2 additional people are allowed only between 9:00 a.m. and 11:00 p.m., without overnight stay and under the responsibility of the booking holder. If this limit is exceeded, the company reserves the right to cancel the stay without refund.
- Responsible use of air conditioning and energy: Please turn off the air conditioning, lights, and electrical appliances when leaving the apartment. The use of air conditioning must be reasonable, keeping doors and windows closed while it is operating. Inefficient or abusive use may result in additional charges if abnormal consumption is detected.
- Order, cleanliness, and waste: Keep the accommodation clean and tidy. Dispose of waste between 8:00 p.m. and 8:00 a.m. in the containers indicated on your booking page.
- Safety and proper use of facilities: Close doors and windows when leaving. Do not tamper with electrical equipment or installations. Immediately report any incident or damage to the Polo Apartments team.
- Prohibition of filming or commercial use: The use of the apartment for pornographic, promotional, advertising, or any other commercial video or photo production is strictly prohibited. This includes the use of the property as a filming location or for any content intended for public or online distribution. Breach of this rule may result in immediate eviction and additional charges for damages or loss of business reputation.
- Consequences of non-compliance: Any serious violation of these rules may result in: Immediate eviction without refund, retention or partial charge of the security deposit, and the claim of damages supported by an official invoice.
6. Right to cancel by the property owner
Polo Apartments reserves the right to cancel a reservation under the following circumstances:
- Evidence of fraudulent use or false information during the booking process or in the details provided by the guest.
- Breach of the terms of use, house rules, or occupancy policy, including exceeding the number of guests, organizing events, or engaging in behavior that could cause damage to the property or disturb others.
- Inability to provide the service due to technical issues, maintenance, force majeure, or external circumstances beyond the control of Polo Apartments.
- Lack of payment authorization or irregularities with the credit or debit card, when the automatic charge system cannot be completed.
- Reasonable risk to safety, property, or neighborhood coexistence, as determined by the management on justified grounds.
In such cases, the guest will receive a full refund, including the 15% deposit, unless the breach is attributable to the guest.7.
7. Applicable law and jurisdiction
These conditions are governed by Spanish law. Any disputes arising from their interpretation or execution shall be submitted to the courts of Marbella (Málaga), with express waiver of any other jurisdiction.
8. Reservation by individuals
This service is intended exclusively for individuals of legal age. Reservations made on behalf of legal entities (companies, associations, etc.) are not permitted. If a reservation made by a legal entity is detected, we reserve the right to cancel the reservation without refund. During the reservation process, the customer must provide a personal identification document (tax ID number, foreigner ID number, or passport).
