1. Purpose
This section regulates the specific conditions applicable to the reservation of vacation apartments made through the website poloapartments.com. By completing a reservation, the user expressly accepts the terms described herein, in addition to the general policies of the site.
2. Booking and payment process
- The reservation is considered confirmed only after the payment of 10% of the total amount, processed via the Stripe payment gateway.
- The remaining 90% will be automatically charged seven (7) days before the scheduled check-in date.
- If the reservation is made less than seven days before check-in, 100% of the total amount will be charged at the time of booking.
- The user expressly authorizes the scheduled charges in accordance with these conditions.
- All payments are securely processed through Stripe, a certified provider under PCI-DSS standards.
3. Modifications and cancellations
- Guests may request a change of dates or cancellation of their reservation with at least seven (7) days’ notice before the scheduled check-in.
- Requests must be made in writing, either via the form provided on the website or by WhatsApp message.
- If the request is made within the deadline, the 10% deposit will be refunded, with deduction of any applicable bank or transaction fees.
- After this deadline, no cancellations or modifications will be accepted, and the scheduled 90% charge will be processed as planned.
4. Security deposit preauthorization
- A preauthorization of €150 will be placed on the guest’s card as a security deposit.
- For stays of up to seven (7) days, the preauthorization is processed within 48 hours before check-in.
- For longer stays, the preauthorization may be processed during the first days of the stay.
- This amount will not be charged unless damage or violations are detected. In such cases, a full or partial charge may be applied, with prior notification to the guest.
5. Check-in, check-out and general rules
- Check-in time: from 15:00 on the day of arrival.
- Check-out time: before 11:00 on the day of departure.
- Guests agree to respect the general rules of coexistence, safety, cleanliness and appropriate use of the apartment, which may be detailed in the guest guide.
6. Right to cancel by the property owner
Polo Apartments reserves the right to cancel a reservation under the following circumstances:
- Evidence of fraudulent use or false data in the booking process.
- Violation of usage or coexistence rules previously communicated to the guest.
- Inability to provide the service due to technical issues or force majeure.
In such cases, the guest will receive a full refund, including the 10% deposit, unless the breach is attributable to the guest.
Applicable law and jurisdiction
These conditions are governed by Spanish law. Any disputes arising from their interpretation or execution shall be submitted to the courts of Marbella (Málaga), with express waiver of any other jurisdiction.
